Welcome to BravoMe.com (“BravoMe” or “Service”), a digital classroom where students can explore, learn and grow together. This service is owned and operated by PlanetBravo, LLC (“PlanetBravo”, “us”, or “we”) and is currently located at http://www.bravome.com (“the Website”). By registering for a BravoMe account (becoming a “Member”) you acknowledge that you have read, accept and are bound by the Terms of Service (“Terms” or “Agreement”) set forth here. We reserve the right to change, modify, add or delete portions of these Terms at any time. If we do this, we will post the changes to the Terms on this page and will indicate that we have done so by changing the date at the top of the page. Please read this Agreement carefully and save it. If you do not agree to follow these or any future Terms, please do not use the Service or Website.
This Agreement includes BravoMe.com's policy for acceptable use of the Service and content posted on the Website, your rights, obligations and restrictions regarding your use of the Service and BravoMe.com's Privacy Policy. In order to participate in certain services, you may be notified that you are required to download software or content and/or agree to additional terms and conditions. Unless otherwise provided by the additional terms and conditions applicable to the services in which you choose to participate, those additional terms are hereby incorporated into this Agreement.
BravoMe is an educational social-networking tool. Using BravoMe, teachers have the opportunity to share information, parents can network with other parents and teachers, and students can post journals, share multimedia content with their peers, and do much more.
The BravoMe experience starts with school teachers registering through our secure registration process. Once registered, teachers can then generate usernames and passwords for their students, who will need parent verification to become full members if they are under 13 years of age.
Eligibility
BravoMe was designed for students, their parents and their teachers (all of whom are “Members” when they register for and use the Service). To have full access to all of our services and features, you must meet these eligibility requirements. Students who are 13 years old or older are able to use our service without the permission of a parent. Students who are under 13 (“Child” or “Children”) must receive verifiable parental consent and have their registration process completed by a parent or guardian to become Members.
Term
This Agreement will remain in effect while you use the Service or are a Member. You may terminate your or your Child’s membership at any time, and for any reason, by following directions found within your profile. You may also send a termination request to support@bravome.com. BravoMe also reserves the right to cancel your or your Child’s membership at any time by sending a notice to you at the email address that was provided at the time of your application. It is the parents’ responsibility to keep BravoMe informed of their current email address by updating their Personal Account section.
Fees. You acknowledge that although BravoMe.com does not currently charge fees, it reserves the right to charge for the BravoMe Services and to change its fees from time to time in its discretion. If BravoMe.com terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.
Password
When you register for a BravoMe account, or are given one by your teacher, you will create a password. You agree to keep your password secure and not to share it with anyone.
In the event that a registered teacher, parent, or student 13 years of age or older loses his/her password, he/she will be able to answer a security question and receive the opportunity to reset the password. In the event a Child (under 13) loses his/her password, he/she can either have the registered parent or teacher reset his/her password or request one him/herself if he/she has provided a valid email address.
Member Conduct, Content and Prohibited Activity
By creating a BravoMe account and making use of our services, you understand and agree that BravoMe is available to you for your personal and non-commercial use only. You also agree that BravoMe may (but is not required to) review and reject any information, intellectual property, content, communication, material, videos, photos, or messages (all of which is “Content”) that are submitted to or on the Service.
You agree that you are responsible for any Content which you post or submit to the Website. You understand and agree that BravoMe in no way owns any of your Content and may not be held responsible for anything that you post, even though it may be stored on our servers. You have the right to delete any of your Content at any time.
BravoMe prohibits any type of illegal or unauthorized conduct, including but not limited to attempting to hack into another’s account, creating a false identity on the Service, forging a “Verifiable Parental Consent,” or uploading certain types of Content (“Prohibited Content”). Prohibited Content includes, but is not limited to, Content that:
In the event that a Member engages in prohibited conduct, BravoMe may (but is not required to) take action including: disabling a Member’s account, deleting Content, or investigating and taking appropriate legal action in its sole discretion.
Please choose carefully the Content you post on BravoMe.com and that you provide to other Members. A child's BravoMe.com profile may not include the following items: telephone numbers, street addresses, last names, and any Prohibited Content. Despite this prohibition, information provided by other BravoMe.com Members may contain inaccurate, inappropriate, offensive or Prohibited Content, and BravoMe.com assumes no responsibility or liability for this material. If you become aware of misuse of the BravoMe Services by any person, please contact BravoMe or click on the "Report Inappropriate Content" link at the bottom of any BravoMe.com page.
BravoMe.com reserves the right, in its sole discretion, to reject, refuse to post or remove any Content (including private messages), or to restrict, suspend, or terminate your access to all or any part of the Service at any time, for any or no reason, with or without prior notice, and without liability.
Copyright Policy
By submitting Content to BravoMe, you represent and warrant that you have the right to post or submit such Content. You may not submit, distribute, or reproduce in any way material that is copyrighted without obtaining the prior written consent of the copyright owner for such material.
If you are a copyright owner and you believe your work has been copied and reused in a way that would violate your copyright, please contact our Copyright Agent and provide the following information in writing: (i) an electronic or physical signature of the owner, plus your address, telephone number and email address, (ii) a description of the work that you claim is copyrighted, (iii) a description of where the infringing material is located on BravoMe, (iv) a statement that (a) you are the owner of the material in question and have a good faith belief that it is not being used by the owner or its agent or as otherwise permitted by law, and (b) under the penalty of perjury, all the information in your notice is accurate.

Non-commercial Use by Members
All services designed and offered by BravoMe are for the personal and non-commercial use of Members, and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by BravoMe.com. Illegal and unauthorized commercial uses of the BravoMe Service are strictly prohibited, including (but not limited to) the collection of names, usernames, or email addresses for the purpose of unsolicited email or contacting Members.
Privacy
Our Privacy Policy is incorporated into these Terms by this reference.
Member Disputes
BravoMe Members are solely responsible for their interactions with other Members. BravoMe reserves the right, but has no obligation (other than in disputes involving potential violations of the Children’s Online Privacy Protection Act), to monitor disputes between Members,
Limitation of Liability
IN NO EVENT SHALL PLANETBRAVO, LLC, ITS SUBSIDIARIES, AND AFFILIATES, AND THEIR RESPECTIVE OFFICERS, AGENTS, PARTNERS AND EMPLOYEES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT OR DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF BRAVOME HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, BRAVOME 'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO PLANETBRAVO, LLC FOR THE BRAVOME SERVICES DURING THE TERM OF YOUR MEMBERSHIP.
Indemnity and Hold Harmless
You agree to indemnify and hold PlanetBravo, LLC, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of (i) your use of the Service or the Website in violation of these Terms, (ii) any breach of these Terms by you, (iii) any Content that you post on the BravoMe Website or through the BravoMe Service.
